The plaintiff in a bellwether case against the maker of Tylenol can introduce expert testimony that acetaminophen can cause liver damage. The bellwether case is a wrongful death action filed by plaintiff Rana Terry, whose sister, Denice Hayes, died of liver failure in 2010 allegedly caused by the consumption of Tylenol. Stengel’s previous rulings in the case were made under Alabama state law, which governs Terry’s case since Hayes was an Alabama resident.
